Yuga Labs, the creator of Bored Ape Yacht Club (BAYC), has won a legal victory against Ryder Ripps, co-founder of the copycat NFT project RR/BAYC. In July 2022, Yuga Labs filed a complaint against Ripps and co-founder Jeremy Cahen, alleging trademark infringement, false advertising, and unjust competition. In a pre-trial summary judgment ruling on April 21, a US district court in California determined that Ripps and Cahen’s RR/BAYC NFT collection infringed Yuga Lab’s trademarks. The court has also ruled that Yuga Labs is entitled to damages and an injunction, to be determined during trial. Ryder Ripps and Jeremy Cahen launched the RR/BAYC NFT collection in May 2022, as a form of protest and satire against Yuga Labs. The project uses identical imagery to BAYC NFTs. Ripps has been linked to a conspiracy theory suggesting that BAYC NFT artwork shows racist stereotypes on purpose. Ripps also claims that BAYC’s logo and branding use symbols similar to those used by the Nazis. The Yuga Labs spokesperson called the legal victory a “landmark” for the web3 industry as a whole. They added that holding counterfeiters accountable is essential for web3’s future.
